Construction and Oil and Gas
Over their years in legal practice, the partners of Yatiswara, Ng & Chan have gained a wealth of experience by providing legal advice to employers, contractors and sub-contractors in the construction and oil and gas industries as well as providing them with legal representation in arbitration, litigation and adjudication proceedings.
The advisory work that the firm provides to parties in the construction and oil and gas industries includes:
-
Reviewing tenders and contract terms during the tender process;
-
Drafting construction contracts for employers and main contractors;
-
Providing legal advice on potential legal claims during ongoing projects; and
-
Advising clients on preparing claims prior to the commencement of arbitration, litigation or adjudication proceedings.
The firm also provides legal representation in arbitration, litigation and adjudication proceedings for employers, contractors and sub-contractors in the construction and oil and gas industries. These proceedings range from relatively straightforward claims for payment of certified sums in construction projects to complex and technical claims involving anything from defective piling to damaged offshore pipelines.
The partners’ experience in Construction Law and Oil & Gas Law also involves advising clients in respect of disputes in construction and oil and gas projects outside Malaysia in countries such as India, Turkmenistan and Myanmar. Where these disputes involve arbitration or other forms of dispute resolution proceedings in Malaysia, the firm is able to provide clients with legal representation. If these disputes involve arbitration or other forms of dispute resolution proceedings in other jurisdictions, the firm is able to work as a team with clients and their legal advisors based in those jurisdictions to help ensure that the disputes are resolved in a manner that is in the clients’ best interests.
